A severe medical error puts the life of a one-day-old infant at risk

According to information received by Hana, on Thursday, November 21, 2024, a one-day-old infant was transferred to the NICU due to respiratory problems requiring specialized care. Subsequently, due to a grave error involving the administration of incorrect medication by the NICU staff, the infant suddenly developed a severe and unidentified infection in the hand.

In this regard, the attending physicians, without providing further explanation, have declared amputation of the infant’s hand as the only way to save the child’s life.

Hana has also learned that despite the family’s efforts and complaints, they have received no response from the hospital authorities or responsible physicians. The latest updates on the infant’s condition indicate that the life of this Baloch infant is in grave danger.

It is worth noting that the legal system of the Islamic Republic of Iran lacks appropriate mechanisms to ensure justice for victims of medical malpractice. Based on current practices, courts often consider such life-threatening medical errors as non-criminal offenses and refer the matter to the disciplinary system of the Medical Council. The relevant commissions frequently issue verdicts of acquittal for the negligent physicians and medical staff by invoking the “lack of fault” argument.

In contrast, modern democratic legal systems categorize such cases, which concern the fundamental right to life, under the theory of risk rather than fault, compelling medical authorities to maximize their efforts to preserve lives.

Additionally, medical errors and negligence in Balochistan are further exacerbated by the systematic neglect and disregard due to the region’s securitization by government authorities and the deployment of non-local physicians and medical staff.
